Our Services

Simply Probate Limited provides probate and estate administration services in accordance with UK law. Our services may include, but are not limited to:

  1. Probate application assistance
  2. Estate administration
  3. Executor services
  4. Legal advice regarding probate and estate matters

Engagement

Upon engaging our services, you will be required to provide accurate and up-to-date information about the estate and any related documentation. We reserve the right to terminate our services if any false or misleading information is provided.

Fees and Payment Terms

  1. Our fees for probate services will be agreed upon at the time of engagement. A full breakdown of fees will be provided in a written agreement.
  2. In some cases, fees may be subject to change due to the complexity of the estate or additional work required. Any additional fees will be communicated and agreed upon in advance.
  3. Payment for services is due within 30 days of the invoice date unless otherwise agreed in writing.
  4. Failure to make payments on time may result in a suspension of services and additional fees for delayed payme

Liability

  1. Simply Probate Limited will perform its services with due care and diligence. However, we cannot be held responsible for any delays, errors, or omissions caused by third-party entities (such as courts or government bodies).
  2. Our liability for any claim, whether in contract, tort, or otherwise, shall be limited to the amount of fees paid for the specific service giving rise to the claim.
  3. We shall not be liable for any indirect or consequential losses, including but not limited to loss of profits, loss of opportunity, or reputational damage.

Client Responsibilities

  1. You are responsible for providing all necessary information and documents related to the estate in a timely manner.
  2. You must ensure that you have the legal authority to instruct us in relation to the estate and probate matters.
  3. Any delay or failure to provide requested information may affect the timeline and outcome of the probate process.

Confidentiality

  1. We will treat all personal and estate-related information as confidential and will not disclose it to any third party except where required by law or with your express consent.
  2. Simply Probate Limited complies with the UK Data Protection Act and the General Data Protection Regulation (GDPR). Our privacy policy provides more information on how we manage your personal data.

Termination of Services

  1. Either party may terminate the engagement at any time by giving 30 days written notice.
  2. In the event of termination, you will be liable for any fees and costs incurred up to the date of termination.
  3. Simply Probate Limited reserves the right to terminate the engagement if you breach any of these terms or fail to cooperate with the probate process.

Dispute Resolution

  1. In the event of a dispute, both parties agree to attempt to resolve the matter amicably through negotiation.
  2. If the dispute cannot be resolved, either party may refer the matter to mediation or arbitration in accordance with UK law.
  3. Any legal proceedings must be brought in the courts of England and Wales.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or the services provided will be subject to the jurisdiction of the courts of England and Wales.

If we are unable to resolve your complaint, you may have the right to refer it to the Legal Ombudsman or another relevant regulatory body.

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our website and communicated to you in writing. Continued use of our services after changes have been made will constitute acceptance of the new terms.
