Frequently Asked Questions

What is probate?

Probate is the legal process that happens after someone dies to make sure their assets are properly distributed according to their will, or if there’s no will, according to the law.

Why is probate necessary?

Probate ensures that the deceased person’s estate is handled properly, legally, and fairly. It makes sure that the right people inherit according to the deceased’s wishes or the law.

Is probate always required?

Not always. Some assets — like jointly-owned property or money in a joint bank account — pass directly to the surviving co-owner and don’t need to go through probate. Additionally, if the estate is very small or consists solely of jointly-owned assets, probate may not be necessary.

Can I apply for probate on my own, or do I need a solicitor?

While it’s possible to apply for probate independently, many find it complex and time-consuming. Choosing Simply Probate offers you the expertise and support of a professional team, reducing the chance of costly mistakes or delays.
